SB 2842 is a landowner rights and public safety bill. Eliminating the use of eminent domain for CO2 pipelines would force private companies to negotiate directly with landowners, helping protect landowner property rights, farmland productivity, and to improve CO2 pipeline safety through improved routing.

Amendments to both the CCS Act and the Public Utilities Act, which are embedded in the SAFE CCS Act, are required to ban the use of eminent domain for CO2 pipelines.

Where sequestration is proposed, there will be CO2 pipelines
The map to the left shows thirteen sequestration sites planned in Illinois. Eight are being reviewed by the U.S. EPA. One of these already has received its draft Class VI well permit.
Recent increases in the 45Q tax credit that were adopted by the Trump administration as part of his One Big Beautiful Bill increased the tax credit for enhanced oil recovery (EOR) to $85 per ton of CO2. While Illinois has recoverable oil, the SAFE CCS Act signed into law in July 2024 prohibits EOR in our state. But pipelines transporting CO2 to the gulf states or Ohio, where EOR already is taking place, could cross Illinois.
